Pinanumpaan ni Rita Daniela ang kanyang sagot sa counter-affidavit ni Archie Alemania sa Bacoor Hall of Justice sa Cavite ngayong Martes, December 17, 2024.

Kaugnay ito ng reklamong acts of lasciviousness na isinampa ni Rita laban kay Archie.

Ayon sa ulat ng GMA News, anim na pahina ang reply-affidavit ni Rita.

Naglalaman ito ng kanyang kasagutan at affirmation sa kanyang reklamo laban kay Archie dahil sa counter-affidavit nito.

Rita Daniela at Bacoor Hall of Justice

Hindi dumating ang legal counsel ni Rita na si Atty. Maggie Abraham-Garduque, pero may dumating na representative ang kanilang kampo para kumuha ng kopya.

Sa counter-affidavit na isinumite ni Archie noong December 10, 2024, mariin niyang itinanggi ang akusasyong may kaugnayan sa acts of lasciviousness.

RITA DANIELA’S LAWYER REACTS TO ARCHIE ALEMANIA’S COUNTER-AFFIDAVIT

Sa ulat ng PEP Troika, una nang inalmahan ni Atty. Garduque ang counter-affidavit ni Archie.

Ayon sa kanyang ipinadalang statement, tila inamin ni Archie ang kanyang mga nagawa kay Rita base na rin sa inihain nitong sagot sa korte.

Buong pahayag ni Atty. Maggie (published as is):

“We received the counter affidavit submitted by respondent Archie Alemania yesterday.

“We are supposed to have a clarification hearing yesterday, but since there are no other evidence attached to the counter affidavit other than the testimonial evidence/allegations of Archie, the fiscal decided that there is no need to conduct clarificatory hearings.

“For us, the counter affidavit admitted that he uttered the words, ‘f*ckable’ and ‘tirahin mo na yan’ when he was at the party of Bea Alonzo.

“He also admitted that while in the car he touched Rita. Albeit, he said that he uttered those words because he was just being wacky and he made the touches to comfort her, this does not erase the fact that he did the acts complained of.

“He also said in his counter affidavit that when Rita got out of his vehicle, she was very angry.

“Why would Rita be angry when he did not do something wrong when they were at the car? If he just touched to comfort her?

“He also admitted that he apologized by sending her a message.

“These are material admissions by respondent Alemania himself in his sworn statement which gives reasonable certainty of conviction to indict him for the crime of acts of lasciviousness.

“His defenses are evidentiary in nature which should be ferreted out in a full blown trial in court.”

Sa January 7, 2025, inaasahang si Archie naman ang magtutungo sa korte para sa pagpapatuloy ng preliminary investigation.

Wala pang pahayag ang kampo ni Archie sa ipinasang reply-affidavit ni Rita.
