Taguig court junks Deniece Cornejo's motion for reconsideration against Vhong Navarro

The motion for reconsideration filed by model-actress Deniece Cornejo against the previous court order that allowed actor-comedian Vhong Navarro to post bail was denied by a Taguig court last January 12.

Judge Loralie Cruz Datahan of the Taguig Regional Trial Court ( RTC) Branch 69 issued the order and explained there was no conformity from the public prosecutor when Deniece filed her motion for reconsideration.

“Time and again, the Supreme Court (SC) has emphasized that criminal actions shall be prosecuted under the direction and control of the prosecutor,” the decision said.

Judge Loralie cited a previous SC decision and maintained that it’s required for criminal actions to be prosecuted under the direction and control of a public prosecutor.

The issue quoted the SC decision, “All criminal actions commenced by a complaint or information shall be prosecuted under the direction and control of the prosecutor.”

“A private party does not have the legal personality to prosecute the criminal aspect of a case, as it is the People of the Philippines who are the real party in interest. The criminal case must be under the direction and control of the public prosecutor,” the decision continued.

Because Deniece failed to comply with the rule, the RTC has decided to deny the motion for reconsideration due to lack of merit.

Just last month, Vhong was granted by the court to post a one-million peso bail for his temporary liberty. The comedian-host was detained for almost three months in relation to the previously dismissed rape cases filed against him.

Vhong was given the opportunity to post bail after the RTC decided that the inconsistencies in the model-actress’s affidavits were “too material to ignore.”
